Types of Online Gaming in NY

Online Casino
Online casino games are not yet legal in New York. Bills to authorise them have been introduced in Albany every year since 2022, and the 2026 bill died in June without the Governor’s support. We track each one. Until a law passes, the only legal casino play is at the state’s licensed land-based casinos.
Online Sportsbooks
New York online sports betting went live on January 8, 2022. Nine licensed sportsbooks operate in the state as of September 2026, including FanDuel, DraftKings, Caesars, BetMGM and Fanatics. You must be 21 or older and physically inside New York to place a bet.
Online Poker
Online poker is not yet legal in New York. Legislation has been proposed alongside online casino bills, and a launch would most likely come as part of a wider online gaming law. New Yorkers can play live poker at licensed card rooms in the state’s casinos.
Fantasy Sports
New York Daily Fantasy Sports has been legal and regulated since 2016. FanDuel, DraftKings, Underdog and PrizePicks all hold New York licences, and the New York State Gaming Commission licenses every contest operator.
Online Lottery
The New York Lottery, founded in 1967, is the largest state lottery in the country. It does not sell tickets online. Licensed courier apps such as Jackpocket, the first courier licensed in New York, buy official tickets on your behalf. The minimum age for lottery play is 18.

Land-Based Casinos

New York has four commercial casinos in the upstate region, opened between 2016 and 2018: Rivers Casino Schenectady, Resorts World Catskills, del Lago Resort and Tioga Downs. Alongside them are tribal casinos run by the Seneca, Oneida and Akwesasne Mohawk nations, and racinos with video lottery terminals at tracks including Resorts World New York City in Queens. In December 2025 the state awarded its three downstate casino licences to Bally’s in the Bronx and to Resorts World New York City and Metropolitan Park, both in Queens, which will bring full casino gaming to the New York City area.
